How a court-appointed report works
Appointment
The court or public prosecutor appoints the expert from the official register. I check the subject matter and my impartiality and flag likely high costs in advance.
Findings
Establishing the facts: analysis of documents, data, ad accounts, websites and tracking. The parties are involved to preserve their right to be heard.
Report
Expert conclusions are drawn from the findings. The written report answers only the technical questions of the court – without legal assessment.
Hearing
Oral explanation at the hearing and answers to supplementary questions from the court and the parties.
Fees
Fees are claimed from the court under the Austrian Fee Entitlement Act (GebAG). The court decides who bears the costs.
For law firms, companies and authorities I also prepare reports outside court proceedings. Questions, scope and fees are agreed in writing in advance.
